Brazil and Apostille Treaty

On December 02, 2015, Brazil deposited its instrument of accession to the Hague Convention of October 05, 1961 Abolishing the Requirement of Legalization for Foreign Public Documents (the “Apostille Convention”). Following the usual procedural steps, the Convention will entered into force for Brazil on August 14, 2016, making it the 111th Contracting State to the Convention.

The above treaty provides for the simplified certification of public (including notarized) documents to be used in these countries have joined the Apostille Convention, by use of a special form called an “apostille” in certifying the document. This mean that any official document issued outside Brazil and destined for this country requires to be authenticated by an Apostille obtained from the State Secretary of State or the U.S. Department of State. The apostille does not need to be ribboned onto the document being certified.

What does Apostille authenticate                                                              

Documents destined for use in participating countries and their territories should be certified by one of the officials in the jurisdiction in which the document has been executed.

An apostille (the French word for “certification”) is an internationally recognized form of document authentication and ensures that public documents issued in one country will be recognized in another country if both are member of Apostille Convention. The Apostille cannot be obtained from a U.S. or Brazilian Embassy. It is issued by designated competent authorities in the USA. Apostille verifies the authenticity of a document signed, certified and/or notarized by a government official or person affiliated with a government entity (notary public, city clerk, county clerk, etc.). An apostille allows another foreign authorities to define that the document it is attached to is genuine and not fraud.
