This is a special declaration made under the oath, stating that according to the U.S. laws, a U.S. citizen has no complication to his/her marriage. This declaration is to be made before two witnesses (a witness may be of any nationality, but must be over 18, with present-day photo ID), before an Italian Consul outside Italy or, in Italy, before a Court official in the city where the marriage is to occur.

Certificate of Non-impediment to marry – Nulla Osta

A Nulla Osta exactly states that there are no impediments whatsoever, or that one is free to marry, according to the laws of the State of which the civilian is a resident. The Nulla Osta is in force for three months.  A declaration (Nulla Osta or Affidavit) if available in the state of your residence can be obtained from the local City Clerk Office.  These certificates are available, for example, in the state New York, New Jersey, California etc. But in some states the Non-impediment certificate simply does not exist.  In this case the only option you have is replacing it with properly prepared and apostilled notarial Affidavit of Single status.
